These Terms of Service ("Terms") govern your access to and use of Aura Engage, an automated customer engagement platform provided by Cyntra ("the Company," "we," "us," or "our"). By accessing or using Aura Engage, you ("Client," "you," or "your") agree to be bound by these Terms.
Aura Engage is a technology platform that enables businesses to automate customer interactions via the WhatsApp Business API using artificial intelligence (Dialogflow CX). Cyntra acts as a Tech Provider, facilitating the connection between your business, your customers, and Meta Platforms, Inc.
By using Aura Engage, you expressly acknowledge and agree to comply with the following Meta policies, which are incorporated herein by reference:

Any violation of Meta’s policies by the Client may result in the immediate suspension or termination of access to Aura Engage.
The Client is the "Data Controller" of their End-Users' information. You represent and warrant that:
Opt-in Requirement: You have obtained valid, explicit, and legally sufficient consent from your End-Users to contact them via WhatsApp before sending any messages through Aura Engage.
Opt-out Management: You will not attempt to bypass the automated "STOP" or opt-out mechanisms provided by the Aura Engage platform.
Lawful Use: You will use the service only for lawful purposes and in accordance with all applicable data protection laws (including GDPR and CCPA).
You agree not to use Aura Engage to transmit or process content related to:
Illegal products or services.
Tobacco, alcohol, or prescription drugs (except where explicitly permitted by Meta).
Gambling, adult content, or deceptive financial services.
Any content that promotes discrimination, hate speech, or violence.
Aura Engage relies on infrastructure provided by Meta Platforms, Inc. and Google Cloud (Dialogflow CX).
Service Levels: Cyntra is not liable for service interruptions, delivery failures, or data delays caused by outages in Meta's API or Google Cloud's infrastructure.
API Changes: We reserve the right to modify our service to comply with updates or changes imposed by Meta or Google Cloud.
Your use of Aura Engage is also governed by our Privacy Policy. Cyntra processes data as a "Data Processor" on your behalf. We implement industry-standard security measures, but you are responsible for the security of your account credentials and any data exported from the platform.
Platform: Cyntra retains all rights, title, and interest in and to the Aura Engage platform, including all Python-based backend code and proprietary integrations.
Client Data: The Client retains ownership of all message content and customer data processed through the platform. You grant Cyntra a limited license to process this data solely to provide and improve the service.
To the maximum extent permitted by law, Cyntra shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the WhatsApp Business API, including but not limited to the banning of your WhatsApp Business Account (WABA) by Meta for policy violations.
Either party may terminate this agreement upon written notice. Upon termination, your access to the Aura Engage dashboard will be revoked, and it is your responsibility to disconnect your WABA from our technical integration within the Meta Business Manager.
These Terms shall be governed by and construed in accordance with the laws of [Insert Your Jurisdiction].
